Working Overtime

  • Overtime worked in the daytime on a regular working day shall be paid for on the basis of 150% of the hourly wage of a regular working day for each hour worked.
  • Overtime worked at night on a regular working day shall be paid for on the basis of 200% of the hourly wage of a regular working day for each hour worked.
  • Overtime worked on a day of weekly rest or on a holiday shall be paid for on the basis of 250% of the hourly wage of a regular working day for each hour thus worked in the daytime, and 300% for each hour worked at night.

Leave in Laos

Annual Leave

In both cases of annual leave, the employee has the right to receive salary or wages in full as normal.
Weekly rest days, official holidays, customary holidays, and personal leave are not counted in annual leave. If an employee is unable to take annual leave because of a reason stemming from their employer, the employer must pay an extra wage to the employee equal to one hundred percent of the normal wage according to the days that the employee was unable to take leave.

Sick Leave​

Personal Leave

  • The employee’s own father, mother, husband or wife and children are injured and hospitalized and there is nobody to take care of them.
  • The employee’s father, mother, husband or wife and children pass away.
  • The employee gets married.
  • The employee’s wife gives birth or miscarries.
  • The employee is affected by natural disasters.

Employees who request personal leave for personal reasons must apply for personal leave with the employer, to be confirmed by the trade union or employee representative or a head of the labor unit.

Maternity Leave

In the event that as a result of giving birth, a woman worker requires leave beyond the set number of days due to treatment and rehabilitation after giving birth, the employee has the right to receive subsidies as determined in the Law on Social Security.

After giving birth, for a period of up to one-year, female employees have the right to rest for one hour per day, or care for their child or have the right to leave to take their child for vaccinations according to regulations. Female employees who miscarry will receive leave for a certain period as per the directions of a physician and will receive salary or wages as normal.

Benefits in Laos

Statutory Benefits

According to the Social Security Law, an employee who has reached the age of retirement, and who has his or her income insured or has contributed for at least 15 years to the Social Security is entitled to receive a pension from the National Security Fund. The amount of the pension depends on the number of years of contribution made and the level of income insured. The Labor Law further adds that, employees who have contributed to the fund for 15 years or longer, have poor health conditions, and have 1-3 years remaining to reach their retirement age, shall also be entitled to retirement benefit.

Bonuses and Additional Benefits

Social security contributions

Deduct a mandatory contribution of 5.5% from the employee’s relevant income.
Make a mandatory contribution of an amount equal to 6% of the employee’s gross salary.

The maximum base salary or income for the calculation of social security contributions is
LAK4,500,000 per month.

Therefore, the maximum contribution payable by the employer is LAK270,000 per month and the maximum contribution deductible from the employee’s salary is LAK247,500 per month.

Severance Pays

  • If employment contracts are terminated unilaterally, either by the employee or by the employer (for justified reasons) the employee will be entitled to a severance payment of 10% of the monthly salary before termination for each month of work.
  • Where an employment contract is terminated by the employer for unjustified reasons, the employee is entitled to compensation of 15% of the employee’s monthly salary for the whole period of working.

The employee is not entitled to severance pay when:

  • They resign voluntarily
  • The termination of employment is their own fault
