Benefits and Leave in Taiwan

Sick leave

When employee’s sickness is covered by the labor insurance, but is less than half-pay, the employer pays the difference (to make up half-pay). If the employee is injured or disabled due to an accident at work, the employer pays them full salary and if after 2 years, the employee does not recover from the occupational injury or disability, the employer must pay them a lump sum of 40 months’ average wage. 

Family Care Leave

Annual leave

  • 3 days for service of more than six months but less than one year.
  • 7 days for service of more than one year but less than two years.
  • 10 days for service of more than two years but less than three years. 
  • 14 days for service of more than three years but less than five years. 
  • 15 days for service of more than five years but less than ten years. 
  • One additional day for each year of service over ten years (up to a maximum of 30 days). 

The period within which accumulated annual leave must be used can be based on service years, calendar years, school years, fiscal years or any other kind of annual system agreed upon between the employer and employee.

Unused leave is carried over to the following year, and if they are not used within 2 years, they will be converted into salary (based on 1st year wage). Unused leave will be paid upon termination of employment contract. 

Maternity Leave

  • If the employee has more than six months of service, she is entitled to full pay during her maternity leave. 
  • If she has been working less than six months, she is entitled to half-pay. 

A male employee is entitled to five days of paid paternity leave when the mother of his child gives birth. 

Parental Leave

  • Worked for the same employer for at least 6 months.
  • Employee’s child is more than 3 years old. 
  • Their spouse is employed.

Termination in Taiwan

 
Dismissal of an employee is permissible for the following reasons: 

  • Closure of business or transfer of ownership. 
  • Company operations are suspended for more than one month by reason of force. 
  • Change of company business nature, requiring a reduction in the number of employees, and there are no suitable job openings for redundant employees. 
  • The employee is confirmed to be incompetent to carry out the work assigned to him or her. 
  • A notice and pay severance to the employee is needed; unless an employee misrepresenting facts at the time of signing the employment contract, violence against the employer, the employer’s family, or fellow employees, the employee is absent from work for three consecutive days or for six days in a month without justifiable reason, or the employee causes damage purposefully. 

Notice Period

  • 3 months to 1 year of employment: 10 days’ notice 
  • 1-3 years of employment: 20 days’ notice 
  • Over 3 years of employment: 30 days’ notice 

Severance Pay

If the employment began after 2005 under the Labour Pension Act, severance pay is calculated based on one month’s average wages for each year of employment. However, the amount paid for each year is equal to 50% of the employee’s average monthly salary.
