Overtime

Where a public holiday falls on a Monday to Friday, overtime is paid at one and a half times the ordinary rate of pay for the first 7.6 hours (i.e. normal daily hours) and at two and a half times the ordinary rate of pay thereafter. Where a public holiday falls on a Saturday or Sunday and no other day is granted in lieu, overtime is paid at two and a half times the ordinary rate of pay. 

Probation Period

However, subject to the employment contract, the employer is legally allowed to terminate the job by giving notice (usually 1-2 weeks or as is mentioned in the employment contract) or by agreeing to pay salary in lieu of notice before the probationary period ends.

Under the Act, employees are entitled to long service leave after a minimum of 7 years’ continuous service with their employer. An employee is entitled to an amount of long service leave on ordinary pay equal to 1/60th of the period of continuous employment, or approximately 6.1 weeks after 7 years.

Termination in Australia

Notice of Termination and Redundancy

The FW Act sets out the minimum period of notice that must be given to an employee depending on the employee’s period of continuous service with his/her employer. The minimum periods are as follows:

Less than 1 year 1 week
More than 1 year but less than 3 years 2 weeks
More than 3 years but less than 5 years 3 weeks
More than 5 years 4 weeks

An employee is entitled to be paid redundancy pay if he/she is terminated because the employer no longer requires his/her job to be done by the employee or anyone else, or because the employer is insolvent or bankrupt. 

The FW Act sets out the minimum amount of redundancy pay that must be paid to an employee depending on the employee’s period of continuous service with his/her employer. The minimum amounts are as follows:
