Employing in Philippines

The Philippines is a southeast Asian nation composed of over 7,000 islands. It is located between the South China Sea and the Pacific Ocean. With 108 million residents, it’s the thirteenth most populous country on Earth. As an archipelago, the Philippines is home to beautiful beaches and a wide variety of flora and fauna.

The economy has a strong agricultural presence, but other sectors are growing. The Philippines is one of the leading suppliers of nurses worldwide. A very low cost of living makes the Philippines very attractive for workers.

Working hours and overtime

Employees in The Philippines work eight hours per day and six days a week (totalling 48 hours per week).

Overtime work beyond eight hours a day is compensated with an additional 25% of the regular basic rate (30% on special holidays).

Employees in supervisory or managerial positions are excluded from overtime pay.

Public Holidays​

Employees are entitled to a minimum of seven days of annual leave after working at a company for three consecutive months. Afterward, one additional day is added per each year, capped at 14 days.

It is common to provide 14-20 days of leave for employees.

Sick Leave

Employers in The Philippines are not legally required to grant employees paid sick leave. Employees can use “service incentive leaves” as sick leaves.

Employees who have made at least three monthly Social Security System contributions in the last 12-month period can claim a sickness benefit (of 90% their salary). However, this allowance will only begin to be paid after all other sick leave has been exhausted.

Maternity leave

Paid leave of up to 105 days is available to women who have made at least 3 contributions to SSS (Social Security System) in the 12 months before the birth. The employer must be notified. Single mothers are eligible for an additional 15 days paid leave. An additional 30 days unpaid leave may be requested.

Eligible women are entitled to 60 days leave following a miscarriage or emergency termination.

Parental leave​

Eligible employees are entitled to at least 60 days (in cases of a normal delivery) or 78 days (in cases of cesarean delivery) of paid maternity leave.

To be eligible for this, the employee must have made at least three monthly contributions in the 12-month period immediately preceding the delivery. The benefit is not based on actual salary but on a Social Security graduated scale, with a maximum monthly salary credit of PHP 15,000.

Employees are also entitled to seven days of paid paternity leave

Employment termination

Employees may be terminated for justified causes or for authorized causes. According to the law, just causes include serious misconduct, willful disobedience, gross and habitual neglect of duties, fraud, willful breach of trust, commission of a crime, and other analogous causes. Employers must give employees written notice of termination. Employees must then have the opportunity to appeal the decision at a hearing. The employer will then render a final decision on termination. Authorized causes include illness, installation of labor-saving devices, redundancy, and other economic reasons.

Workers who are pregnant or on maternity leave cannot be terminated.

Notice period

For resignations, employees must provide a minimum of 30 days notice.

The notice period for dismissals over an authorized cause (business or health reasons) is 30 days.

Dismissals over just cause (employee misconduct or neglect) do not require a notice period.

Severance pay

Severance pay is not required for termination for a just cause. For authorized causes, severance pay of one months pay or one half month’s pay for every year of service, whichever is greater.
