Employing in Malaysia

Malaysia is a tourism hotspot with rich cultural diversity, and an established economic superpower among the ASEAN countries. For over half a century, the Malaysian economy has experienced significant economic growth, driven by gains in the mining, tourism, commerce, pharmaceuticals, and manufacturing industries in particular. Kuala Lumpur is now home to a burgeoning tech sector with a strong base of digital talent and highly skilled services professionals. This Southeast Asian nation is a prime destination for employers looking for quality team members, and many businesses establish an Asian hub in the city affectionately know as KL.

Working hours

Malaysia Employment Act, where the law allows that, by agreement between the employers and employees, where the number of hours of work on 1 or more days of the week is less than 8 hours (for instance, some workers are required to work half day on Saturday or some not even required to work on Saturday), the limit of 8 hours may be exceeded on the remaining days of the week, provided that no employee shall be required to work for more than 9 hours in 1 day or 48 hours in 1 week.

Overtime

For any overtime work carried out more than the normal hours of work, the employee shall be paid at a rate not less than One-and-a-half times the hourly rate of pay. Rest days, the employee shall be paid at a rate Two times the hourly rate of pay. Public holidays, the employee shall be paid at a rate Three times the hourly rate of pay.The Employment  (Limitation of Overtime Work) provides that the limit of overtime work shall be a total of 104 hours in any 1 month. This means an average of about 4 hours in 1 day. The employers must be mindful that they must not require any employee under any circumstances to work more than 12 hours in any one day.

Sick leave

The number of paid sick days in Malaysia also depends on the duration of employment. Thus, those employees whose illness doesn’t require hospitalization are entitled to:

  • 14 days per year if employed for 1-2 years,
  • 18 days per year if employed 2-5 years,
  • 22 days per year if employed longer than 5 years.

The illness should be confirmed by the medical practitioner, medical officer, or dental surgeon. At the same time, the employees should inform their employers on sick leave during 48 hours after commencement or be deemed absent from work without reasonable excuse. If the illness is more serious and requires hospitalization, the employees receive 60 days of paid sick leave in total, notwithstanding the period of employment.

Maternity leave

The law also provides paid leave entitlements to women in connection with pregnancy. According to the Employment Act, a female employee involved in the private sector has been entitled to a total of 60 consecutive days of maternity leave while public sector employees were entitled to 90 days.

Annual leave

In Malaysia, the employees are entitled to paid annual leave, which depends on the period of employment as follows:

  • 8 days per year for employees who have worked 1-2 years.
  • 12 days per year for those who have worked 2-5 years.
  • 16 days per year for employees who have worked longer than 5 years. 

Those who have worked for less than a year are not eligible to paid leave unless they leave the company in which case their paid leave will be prorated. For example, the employees who have worked for 6 months and are leaving the company are eligible for 4 days of paid annual leave.

Employment termination

Employee contracts can be terminated if a just cause is established, such as dishonesty, negligence, fraud, or any other work-related offenses and employees reserve the right to dispute their dismissal as unfair.

Severance pay

Employees who’re dismissed unfairly (i.e., for reasons not related to their performance or conduct) are entitled to severance packages equivalent to their tenure working with an employer.

  • Up to two years of employment: 10 days pay for each year of service
  • 2 – 5 years: 15 days pay for each year of service
  • 5+ years: 20 days pay for each year of service

Notice period

There is no stipulated notice period required under Malaysian employment law.
